General conditions of the program of fidelity NAVIVOILE engagement
General conditions of the NAVIVOILE loyalty programme (creation 19 February 2023 – version of 19 February 2023)
The NAVIVOILE Loyalty Programme (hereinafter the “Programme”) is proposed by the company NAVIVOILE (hereinafter “NAVIVOILE”), a single-person simplified joint-stock company with share capital of €10,000, Registered in the Register of Commerce and Companies of Narbonne under number 837 574 573, whose registered office is 23 impasse Maurice Dagniac, 11210 Port la Nouvelle.
NAVIVOILE, offers NAVIVOILE customers a loyalty programme called the “NAVIVOILE loyalty programme” (hereinafter the “Programme”).
By subscribing to the Program, the person subscribing to the Program (hereinafter the “Member”) hereby accepts without reservation the following conditions (hereinafter the “General Conditions”).
I. How and where to join the Programme?
The Programme is accessible to natural persons (excluding associations, companies, works councils, sports clubs, etc.) who are of legal capacity.
To be able to join the Program, the customer must own or open a NAVIVOILE account for the purpose of booking a NAVIVOILE cruise on the NAVIVOILE website www.navivoile.com.
Membership in the Program is free of charge, with the exception of Internet connection costs required to use www.navivoile.com. Internet connection costs are the sole responsibility of the Member.
The Programme is applicable in metropolitan France (including Corsica).
Membership in the program is:
- Either on request of the customer at our NAVIVOILE ticket offices (at opening times and dates)
- Or directly at www.navivoile.com
In addition, membership is automatically realized when a customer, with a NAVIVOILE account or wishing to book a NAVIVOILE cruise on the NAVIVOILE website www.navivoile.com, uses this account to make an online product purchase (cruise or gift voucher).
The Program cannot be implemented manually after a purchase. It is therefore imperative to join the Program voluntarily by ticketing or automatically by creating an account in order to benefit from the Program. Therefore, all orders made before February 19, 2023 will not be eligible for this Program and its benefits. A client can only register for the program once. This membership is strictly personal and cannot benefit another person. The Direct Clearer may not give or lend its account identifiers to a third party. In case of doubt, NAVIVOILE reserves the right to request proof of identity from the cardholder and/or not to award points or other benefits related to the loyalty program.
The Program is dematerialized and the discount code resulting from a certain accumulation of loyalty points will be sent to the Member on the email address entered in accordance with III. of this Agreement whose subject title is “You received a discount coupon”.
II. What information do I need to give in order to join ?
In order to join the Program, the customer must open a NAVIVOILE account/Book a NAVIVOILE cruise on the NAVIVOILE website www.navivoile.com and fill in the following fields :
- Given name
- Mobile phone
- Valid email address
III. What are the benefits of the Program ?
When you join the Program, you earn loyalty points when you purchase cruises or gift vouchers online at www.navivoile.com.
If you have to cancel the cruise and ask for the total or partial refund accepted in advance by NAVIVOILE (see General Conditions of Sale), the loyalty points corresponding to the amount refunded will be deducted from your prize pool and your point balance will then return to the initial stage before ordering. If a discount coupon had been issued on your email, it would be cancelled.
If NAVIVOILE should cancel the cruise for technical or meteorological reasons and you request a full refund, the loyalty points corresponding to the amount refunded will be deducted from your prize pool and your point balance will then return to the initial stage before ordering. If a discount coupon had then been issued on your email, it would still be active (duration 12 months) and if your remaining loyalty points balance were to be insufficient, the latter would become negative.
If NAVIVOILE were to cancel the cruise for technical or meteorological reasons and you requested the postponement, the fidelity points of the initial order would remain identical (if identical postponement for the same cruise). If a discount coupon had been issued on your email, it would still be active (duration 12 months).
Each point has a validity of 24 months from its acquisition but NAVIVOILE reserves the right to extend this validity unless otherwise advised by the Member.
NAVIVOILE may propose ad hoc commercial operations and/or ephemeral “missions” allowing Members to accumulate more points. NAVIVOILE gives itself the right to adjust the mechanism of cumulation of points if necessary, both for the points accumulated by the purchase of cruises and/or gift vouchers and for the points obtained in the context of a specific commercial operation or an ephemeral mission.
From 350 points: the Member will automatically receive a discount coupon with a value of €15 valid for 12 months, from the date on which it was generated. These 350 points will be automatically deducted from the points balance.
From 700 points: the Member will automatically receive on his email a discount coupon worth €30 valid for 12 months, from the date on which it was generated. These 700 points will be automatically deducted from the points balance.
From 1050 points: the Member will automatically receive on his email a discount coupon worth €45 valid for 12 months, from the date on which it was generated. These 1050 points will be automatically deducted from the points balance.
To take advantage of this discount coupon, the Member will use the code sent to him by courier and entered on his discount coupon. They must then insert this code when booking the corresponding cruise in the “promo code” field. The Member can order any cruise or gift voucher with this code. The amount of this discount coupon will then be deducted from his new order (valid only for any order greater than or equal to the total amount of the discount coupon).
Should NAVIVOILE terminate the Programme in accordance with IX. present, in the event of unsubscribe on the part of the Member, or in the event of the cancellation of the Member’s participation by NAVIVOILE in the cases provided for in V. hereof, the points of the Member will be definitively lost.
IV. Where can I use my points ?
No consultation of the pool by the Member is possible given the system programming put in place.
Only the accumulated loyalty points can be consulted by NAVIVOILE.
The accumulation of loyalty points is effective as of the automatic membership of the Member.
You can spend your points via the discount codes received on your email at www.navivoile.com or on request of the Member at our NAVIVOILE ticket offices (at opening times and dates).
The accumulation of loyalty points is effective for purchases made after the Customer’s membership. NAVIVOILE is under no obligation to allocate to the Customer’s account, the purchases made by the latter before its automatic registration in the Program. Similarly, to generate points during its purchases the customer (reminder the Member) must either:
- Request it from our NAVIVOILE ticket offices (at opening times and dates)
- Automatically at www.navivoile.com when ordering
V. What happens if my account is used fraudulently ?
In the event that the Member does not comply with the present conditions of the Program, uses the Program in bad faith, or if NAVIVOILE detects a fraudulent use of the Program via the credentials of the member, NAVIVOILE reserves the right to cancel participation in the Program and the Member could no longer benefit from the loyalty points acquired without NAVIVOILE being bound to any compensation in respect of it.
If the Member finds a fraudulent activity on his loyalty account, he must notify NAVIVOILE without delay, failing which any activity observed on the account will be attributable to him.
VI. How do you use my personal data
As part of the management of the NAVIVOILE loyalty program, NAVIVOILE collects a certain number of personal data (above II. What information do I have to give in order to be able to join?).
In accordance with the General Data Protection Regulation of the European Union (the «GDPR») and the legislation in force, NAVIVOILE informs you about the processing of your data on «Privacy Center» on our website www.navivoile.com.
VII. How can I change my personal information?
As part of the NAVIVOILE loyalty programme, the Member may modify his personal information via the “MY ACCOUNT” section of the website www.navivoile.com. If you have any questions about the management of your personal data, you can contact us at firstname.lastname@example.org.
VIII. Is it possible to unsubscribe from the NAVIVOILE loyalty program ?
The NAVIVOILE loyalty program is a free service associated with the NAVIVOILE customer account. If the Member wishes to withdraw from the Program, it is necessary to delete his NAVIVOILE account or we invite him to contact our customer support on the email: email@example.com. All your points and rewards will then be deleted without the possibility of recovering them.
IX. Modification of these conditions
NAVIVOILE reserves the right to modify these Program Terms or to terminate the Program at any time without it being necessary for NAVIVOILE to justify its decision.
Any substantial modification of this Agreement shall be the subject of prior notification within a reasonable time, by the means of communication chosen by NAVIVOILE, to the Members.
X. Applicable Law and Litigation
These General Conditions are subject to French law.
