NAVIVOILE Cruise Terms and Conditions
Please consult the general terms and conditions of sale applicable to all our maritime services.
ARTICLE 1: Application of the General Terms and Conditions of Sale
NAVIVOILE SASU enters into these terms and conditions of sale with the "buyer," whether a tourism professional or a private individual. We apply these rules to all bookings made via our website, by mail, or by email.
Consequently, booking a pfv cruise implies full and unreserved acceptance of these Terms and Conditions. These conditions supersede any other document, such as brochures or catalogs, which are for informational purposes only. Furthermore, only written acceptance from NAVIVOILE can validate any special condition that deviates from these regulations.
Finally, NAVIVOILE reserves the right to modify its terms and conditions at any time. In this case, we apply the terms and conditions in effect on the date the order was placed.
ARTICLE 2: Characteristics of the services offered
Our brochures and website present all available services, subject to availability. While our photographs are accurate, they do not guarantee a perfect match with the services offered, particularly regarding colors and camera angles.
ARTICLE 3: Conditions for modifying a cruise
3.1 โ On the initiative of NAVIVOILE:
The customer is not entitled to any compensation in the following cases:
- Change of route due to compelling circumstances or to provide assistance to a ship in distress.
- Program changes due to adverse weather conditions to ensure safety.
3.2 โ At the client's initiative:
No refund will be given for any trip interrupted or shortened by the client. Similarly, we do not refund unused services, regardless of the reason.
ARTICLE 4: Prices
Our prices include VAT at the rate applicable on the date of the order. NAVIVOILE may change its prices at any time; however, the buyer pays the price confirmed on the day of purchase. This price includes transport and the meals stipulated in the contract, but excludes the snack/bar service, which remains an additional charge.
ARTICLE 5: Promotions
5.1 โ Loyalty program:
NAVIVOILE offers a specific loyalty program for its customers. You accumulate points on online purchases using a non-refundable promotional code. Please note that this code cannot be combined with other offers, ANCV holiday vouchers, or in-store purchases.
5.2 โ Various promotional codes:
All NAVIVOILE promotional codes are non-refundable and cannot be combined with current promotions or orders by quote.
ARTICLE 6: Rights and obligations of the carrier NAVIVOILE
6.1 โ The carrier's obligations:
NAVIVOILE is committed to conducting the cruise diligently and ensuring the safety of its clients. We are responsible for the proper execution of the contract, except in cases of force majeure or actions of third parties. Furthermore, we insure the boat and its crew against navigational risks at our own expense.
6.2 โ Limitation of Liability Clauses:
The carrier NAVIVOILE declines all responsibility for the loss, damage or theft of personal belongings during the trip.
ARTICLE 7: The rights and obligations of the client
The client is prohibited from bringing alcoholic beverages or prohibited goods on board. If fishing is involved, you assume responsibility for the equipment entrusted to you. The loss of a fishing rod will result in the forfeiture of a โฌ500 deposit after three months without compensation from your insurance company.
ARTICLE 8: Booking and Payment Terms
8.1 โ Booking via the website:
To validate your order, you must follow these steps:
- Complete the customer information form.
- Complete the online booking form.
- Pay the required deposit to confirm the transaction.
8.2 โ Reservation by mail or quote:
After accepting the quote, the client pays a 50% deposit upon booking and settles the balance upon boarding.
8.3 โ Default on payment:
Failure to pay an installment will automatically result in the cancellation of the cruise.
ARTICLE 9: Cancellation, modification or delay
9.1 โ Cancellation by NAVIVOILE:
If there are insufficient passengers, the cruise will proceed subject to a minimum number of passengers. If this minimum number is not reached at least 12 hours before departure, the cruise will be automatically canceled. The purchaser or customer will receive an immediate refund of all sums paid, or can reschedule their cruise for a later date. The minimum number of passengers depends on the type of cruise; please refer to the website's "Terms and Conditions" for details.
The cruise may be subject to delays, changes to the itinerary, or cancellation due to unforeseen events or compelling circumstances, which only the carrier NAVIVOILE can assess. These circumstances include, but are not limited to, adverse weather conditions, technical problems, assistance/rescue operations (such as rescuing a vessel or swimmer in distress), strikes, demonstrations, or economic constraints.
In the event of adverse weather conditions or a technical problem, and at the discretion of the carrier NAVIVOILE, the cruise will either be postponed or fully refunded, at the buyer's or client's discretion (except in the case of payment via ANCV Chรจque-Vacances Connect, where a 3,5% commission will be deducted from the total amount). In all other cases, apart from adverse weather conditions or a technical problem, the buyer or client is informed that any cancellation, modification, or delay may occur without prior notice, refund, or compensation.
9.2 โ Cancellation by the customer:
In the event of cancellation by the buyer or client not covered by their insurance, the carrier NAVIVOILE will retain, as a penalty, a portion of the sums already paid by the buyer or client. The amount of the penalty will be determined based on the date of cancellation of the cruise.
โ more than 3 months before departure: 25% of the price
โ less than 3 months and more than 40 days before departure: 50% of the price
โ less than 40 days before departure: 100% of the price
ARTICLE 10: Safety and hygiene instructions
NAVIVOILE will intervene in the event of public disturbances or failure to comply with safety instructions. For obvious reasons, running or jumping on board is prohibited. Furthermore, smokers must use only the designated outdoor smoking area.
ARTICLE 11: Accessibility on board
Participation in cruises requires good health. We advise pregnant women and people with disabilities to inquire about the risks before booking. Indeed, sea conditions may make boarding inadvisable.
